This Terms of Service is an agreement between Halo Limited with its registered office at 40/2A Warszawska Street, 40-008 Katowice, Tax ID: PL9542880835, REGON: 54046242600000, entered into the Register of Entrepreneurs of the National Court Register, maintained by the District Court for Katowice-East in Katowice, VIII Commercial Division of the National Court Register under the number KRS 0001145505, the owner of the "Seeya" platform available at seeya.uk, and you, the user of this Platform. Payments processed through the platform may also involve Mikołaj Buczak, ul. Karoliny 13 lok.37, 40-186 Katowice, Tax ID: 5742076053, REGON: 522054463, as an additional payment beneficiary. Any questions regarding the Platform can be directed to the email address: contact@seeya.uk or by phone: 570 536 333. By using the Platform, you agree to the Terms of Service and Privacy Policy, available at seeya.uk/Privacy. This document defines the rules for using the Platform and our obligations to you. If you do not accept them, you should stop using the Platform. The Platform facilitates loyalty program management for various industries, including stores and service points. We kindly ask you to familiarize yourself with the Terms of Service. We reserve the right to modify them to adapt to changes in legislation, services, or user needs. We will inform you about major changes in advance.
2. Definitions
Platform / Application / Web Application - refers to the "Seeya" platform available at seeya.uk and in subdomains of this address. The Platform enables management of loyalty programs, providing tools for recording customer interactions with businesses.
Owner / We / Us / Halo - refers to Halo Limited, the owner of the "Seeya" platform. The Owner is responsible for maintaining, developing, and ensuring the proper functioning of the Platform, as well as providing support to users.
User / You / Your - refers to a person using the services offered by the "Seeya" platform. A User can be both a private individual and a business that uses the Platform's features to manage customer loyalty.
Terms of Service - refers to this document defining the rules for using the "Seeya" platform. The Terms of Service are binding for both Users and the Owner of the Platform, and define the rights and obligations of both parties.
Privacy Policy - a document defining the rules for processing personal data of users of the "Seeya" platform, available at seeya.uk/Privacy. The Privacy Policy specifies how users' personal data is collected, stored, and processed.
Loyalty Program - refers to the platform functionality that enables businesses to manage customer loyalty. The Loyalty Program allows businesses to reward customers for regular use of their services through loyalty stamps and other forms of gratification.
Loyalty Stamp - electronic confirmation of service use, registered on the platform as part of a loyalty program. These stamps are awarded to customers by businesses and are recorded in the Platform's system as proof of using a specific service.
Business - an economic entity using the platform to manage loyalty programs. A Business can independently define the conditions of the loyalty program, rewards, and how they are awarded to customers, using the tools available on the Platform.
Payment Processing - any payment transactions processed through our platform may involve Halo Limited as the primary service provider and Mikołaj Buczak (Tax ID: 5742076053, REGON: 522054463) as an additional payment beneficiary, in accordance with our payment processing partnership agreement.
3. Registration and User Account Access
To fully use the functions and services offered on the "Seeya" platform, a user account is required. The registration process takes place directly through our website.
During registration, you will need to provide your phone number and create a unique password that will be used to log into your account. In the future, after the first login, your login details may be remembered on your device, which will enable automatic login during subsequent visits to our platform.
If you suspect that your password has been disclosed or someone else has gained access to your account without your consent, you should immediately take action to secure your account. Please notify us immediately of the situation by sending a message to the email address: contact@seeya.uk. Upon receiving such a report, we will take all necessary steps to secure your account and restore its security. You can also use the password change function.
Your login password is the key to your account and should be treated with the utmost caution. For your security, we recommend that you do not share your password with third parties and keep it in a safe place. Remember that we, as platform operators, or businesses providing services through our platform, will never ask you for your password in any form.
4. Privacy Protection
All personal data that we collect and process in connection with your use of the "Seeya" platform is stored and processed in accordance with applicable laws, in particular the General Data Protection Regulation (GDPR).
As part of providing services on our platform, we may be required to share your personal data with store owners, service providers, and their employees with whom we cooperate. The shared data may include information contained in your user profile, such as name and surname, phone number, email address, data regarding your history of using business services, and details about your use of our platform. Sharing this data is necessary for the proper functioning of the loyalty program and the realization of benefits resulting from participation in it, such as collecting loyalty stamps.
Data transfer is always in accordance with recommended security standards and occurs only to the extent necessary to achieve specific goals. Store owners, service providers, and their employees who use our platform are obliged to protect your data in accordance with applicable laws.
By using the "Seeya" platform, you consent to the processing and sharing of your data in accordance with our Privacy Policy. If you do not consent to such activities, please refrain from using our platform. Your decision to stop using the platform will not affect the right to withdraw consent for the processing of data that has been previously collected, in accordance with data protection regulations.
We ensure that your data is processed only as long as necessary to achieve the purposes for which it was collected, and in accordance with applicable regulations. 5. License for Platform Use
We grant you a personal, non-exclusive, free, non-transferable, and irrevocable license to use the "Seeya" platform, available at seeya.uk. This license allows you to use our platform in accordance with the provisions of these Terms of Service. This license also covers all future updates and changes that may be made to the platform. We reserve, however, that some updates may be subject to additional terms, about which we will inform you at the time of their introduction.
Our license is intended to enable you to use the features we offer and to benefit from the loyalty programs available on the "Seeya" platform. The granted license is limited to personal use, which means that the platform is intended exclusively for you and you cannot transfer or share your access to other individuals or entities without our express consent.
It should be emphasized that the rights to the "Seeya" platform and all related services and content remain the exclusive property of the Owner. The granted license does not transfer to you any intellectual property rights to the software, content, or services available on our platform. This means that you are not authorized to copy, modify, publish, decompile, reverse engineer, create derivative works, share, sublicense, or distribute any elements of our platform without our express written consent.
Using the "Seeya" platform in a manner contrary to the provisions of these Terms of Service may result in the withdrawal of the granted license, which means that your right to use our platform may be immediately terminated. We ask that you use our platform in accordance with its intended purpose and with respect for copyright and other intellectual property rights that protect our business.
6. Owner's Rights
As the owner of the "Seeya" platform, we possess all rights to the platform, its content, and all related services. This means that all elements that make up our platform, from the smallest graphical details to the most complex fragments of source code, are covered by our intellectual property rights and remain our exclusive property. We would like to discuss in detail what this means for you as a user and which elements of our platform are protected by copyright, trademarks, and other intellectual property rights.
6.1 Copyright and related rights
All materials published on the "Seeya" platform, including but not limited to: texts, images, graphics, platform logos, icons, maps, video and audio clips, editorial content, advertisements, data compilations, page layout, and source code, are protected by copyright or license. This means that we have full right to decide on their use, distribution, and modification. Copyright ensures our control over how our content is used and protects against unauthorized copying, distribution, or modification by third parties.
6.2 Intellectual property rights to software
Our platform is based on advanced software that has been carefully designed, developed, and implemented by our team. All source code, algorithms, databases, and technologies forming the foundation of the "Seeya" platform are our exclusive property and are protected by intellectual property laws. In practice, this means that no person, company, or organization can copy, modify, publish, distribute, or otherwise use our software without our express consent. This applies to both the source code itself, as well as any elements that make up the user interface and the functionality of the platform.
6.3 Page layout and content structure
The way we have organized and presented content on our platform, including the selection and arrangement of content, is also protected by intellectual property rights. This means that our unique page layout, navigation, information structure, and method of content presentation constitute our right and cannot be copied or imitated by other websites or applications without our consent.
6.4 Global protection
All the above-mentioned elements of our "Seeya" platform are protected by copyright and other intellectual property laws worldwide. This means that our rights are recognized and protected not only in Poland but also in other countries. Any violations of our rights may result in appropriate legal action, both at the national and international level, to protect our interests and ensure compliance with the law.
6.5 Exclusions and reservations
It should be noted that our intellectual property rights do not cover content provided by users on the platform. This content remains the property of the users who provided it, although its use on our platform is subject to the terms specified in these Terms of Service.
6.6 Dispute resolution
In the event of any dispute, controversy, or claim arising from these Terms of Service, the use of the "Seeya" platform, or in connection with these matters, the parties undertake to attempt to resolve the dispute amicably. However, if such attempts do not lead to a satisfactory resolution in a reasonable time, any disputes will be resolved exclusively through arbitration.
Arbitration will be conducted in accordance with applicable Polish law regarding arbitration, including the provisions of the Civil Procedure Code and other relevant regulations. The arbitration proceedings will be conducted by a single arbitrator chosen jointly by both parties to the dispute. In the event that the parties are unable to reach an agreement on the choice of an arbitrator, the arbitrator will be appointed by the appropriate arbitration body in accordance with the law.
7. Prohibited Use
Using the "Seeya" platform involves the need to comply with certain rules that aim to ensure safety, legal compliance, and protection of our users and resources. As a condition of using our website and related services, you agree not to use our platform in a way that is contrary to applicable law, regulations, local, national, or international provisions. Using the platform for illegal or unauthorized purposes is strictly prohibited.
You agree to refrain from any activities that may constitute fraud, including impersonating other individuals, companies, or entities, making false transactions, or other actions aimed at misleading or deceiving other users of the platform. You are not allowed to use our platform to transmit, distribute, or install viruses, malware, Trojan horses, worms, or any other harmful codes that may disrupt the operation of our platform, computer systems, or harm other users.
The "Seeya" platform cannot be used as a tool to promote unsolicited advertisements, spam, phishing messages, or other forms of unwanted communication. You agree not to engage in any activities that could lead to the distribution of unsolicited content to other users. It is prohibited to use our platform to simulate communication from us or any other service in order to extort personal data, authentication information, or any other confidential data from users. Such activities are strictly prohibited and constitute a serious violation of the law.
You also agree not to use the platform in a way that disrupts its operation, including not to attempt to disrupt the operation of our site, our IT systems, or the systems of other users. This also applies to attempts to gain unauthorized access to computers, data, systems, accounts, or networks, and to take actions aimed at bypassing password or user authentication methods. All such activities are strictly prohibited and may lead to immediate suspension of your access to our platform, as well as to legal action.
8. Disclaimer
Use of the "Seeya" platform and all related services is entirely at your own risk. Despite our efforts to ensure high-quality services, we cannot guarantee that the use of the platform will be completely free from risk, technical problems, or unforeseen complications. Therefore, any decisions made while using the platform are solely yours and are made at your responsibility.
To the greatest extent consistent with applicable law, we do not provide any warranties, both express and implied, regarding the functioning of the "Seeya" platform. We cannot guarantee that our services will always meet your expectations, operate without interruption, or fully meet your needs. Use of the platform, including decisions made based on it, are solely your responsibility.
We are not responsible for any damages that may result from using the "Seeya" platform, including damage to your computer equipment, data loss, or other technical problems. We also cannot guarantee that the platform will function without errors, that it will be compatible with all devices or operating systems, or that it will meet all your requirements.
Although we make every effort to secure our platform against malware, viruses, and other threats, we cannot provide any guarantees that our services are free from such threats. Use of the platform is at your own risk, which means that you bear all risk associated with potential damage to your hardware, mobile devices, or network resulting from using our services. Access to the "Seeya" platform and the services offered on it may sometimes be limited or impossible, for reasons such as technical failures, maintenance breaks, problems with internet service providers, as well as factors beyond our control, such as disruptions in the operation of mobile networks. Although we take all possible steps to ensure the highest availability of our services, we cannot guarantee that the platform will be available at all times and without interruptions. In such situations, we cannot be held responsible for the inability to use our services.
We encourage you to regularly back up important data, use up-to-date security systems, and monitor your equipment to minimize the risks associated with using the Internet and our services. Remember that the security of your data and devices largely depends on the precautions you take.
9. Changes in Platform Content
Our "Seeya" platform is a dynamically developed tool that may undergo regular updates and modifications to improve service quality, adapt to changing user needs, and introduce new features that may increase the value of using our offer. We reserve the right to make such changes when we deem it necessary, in response to technological advances, changes in legislation, user suggestions, as well as our own business priorities.
These changes may concern both the content posted on the platform and the functionalities themselves offered as part of our services. This may include adding new options, updating existing tools, bug fixes, as well as removing features that no longer meet market or user requirements.
We make efforts to inform you about any significant changes in the functioning of the platform in advance, especially if they may affect the way you use our services. Our goal is to ensure that you are fully aware of upcoming modifications, which will allow you to prepare for potential changes in using the "Seeya" platform.
Although our modifications primarily aim to improve your experience with our platform, we encourage you to regularly review the terms of service to stay up to date with all updates and news.
10. Information about the Web Application
As part of the provided service, a Web Application has been made available, which is a platform designed to enhance the offer of physical businesses with loyalty functions. It operates directly in the web browser. Our platform has been designed with various industries in mind, enabling entrepreneurs, both in the service and trade sectors, to effectively manage loyalty programs. Within the Application, employees of businesses cooperating with us can register electronic confirmation of service use, which is presented in the Application in the form of a stamp on a loyalty card. Collecting a sufficient number of them within a specified time can then be exchanged for discounts, bonuses, and freebies, which the entrepreneurs themselves define and make available as part of their activities.
Our platform is available exclusively online, which means that users can use it without needing to install any application on their mobile devices or computers. All you need is a device with Internet access and a web browser – regardless of whether it is a desktop computer, laptop, tablet, or smartphone.
Although we make every effort to ensure that our platform is always available and functions without disruptions, we cannot guarantee that it will operate continuously. We reserve the right to temporarily suspend, withdraw, or limit the availability of certain platform features for business, technical, or operational reasons. This may include periodic maintenance work, system updates, or other activities that are necessary to improve platform functionality or adapt it to changing market conditions. However, we will try to inform you about any planned interruptions in the platform's operation in advance, so that you can prepare accordingly.
To use the "Seeya" platform, you must have an end device with Internet access and an installed current version of a web browser. Our platform is compatible with most popular operating systems and browsers, ensuring ease of use without the need to install additional software.
The purpose of the "Seeya" platform is to enable users and businesses to conveniently interact and reward customer loyalty, which contributes to increasing customer engagement in the company's activities.
11. Payment Processing
Payments processed through our platform are handled by Halo Limited as the primary service provider. Additionally, some payment transactions may involve Mikołaj Buczak (ul. Karoliny 13 lok. 37, 40-186 Katowice, Tax ID: 5742076053, REGON: 522054463) as an additional payment beneficiary under our payment processing partnership agreement. By using our platform and its payment processing services, you acknowledge and consent to this arrangement.
12. Right to Complaint
If you believe that the services provided by the "Seeya" platform are not being performed in accordance with our obligations. You can submit a complaint by sending an email to: contact@seeya.uk.
The content of the complaint should include necessary identification information, such as your name and surname, and a detailed description of the problem, for example, irregularities in the provision of the service, along with the exact date and time when the problem occurred. Additionally, you should indicate your request, i.e., what you would like to achieve as a result of filing the complaint.
Complaints that do not contain the required identification information or do not specify what the problem is may not be considered. Therefore, it is important that the submission is complete and detailed.
All complaints are considered in accordance with the provisions of these Terms of Service and the laws applicable in Poland. Complaints are considered in the order of their receipt, and we make every effort to provide a response to the submission within 30 days of its receipt.
